It is both one and five according to the Constitution. Amendments and laws are passed by the legislative branch with the House voting first and the Senate to check before it can be signed off on or vetoed by the executive, which can also be overruled. Equal protection under the law means in its application, which the Judicial Branch is responsible for maintaining. So it is the application of laws and 'following' the rule of law that is meant to maintain order. and under the principle of subsidiarity that entails local, state, tribal and federal levels, are applied depending on the circumstances. The petition clause of the 1st Amendment makes change possible as long as any proposed law doesn't contravene original application and existing precedent. I sure wish we were still using the Constitution, but they aren't even pretending anymore.
It was supposed to mean that we have rules and not rulers but public servants.
