Before this change, California's law was already too lenient, because it required prosecutors to prove not only that the infected party knew he was HIV positive, but to prove that he intended to infect his partner. So, it was almost impossible to prove, unless the guy said "Ayyy, ima giv u da AIDS now, bish!" while he nutted. "But I didn't mean to infect him/her" was actually a defense, unlike in most other states, where knowingly exposing someone to HIV is a felony, period.

So, this is insane. It's making purposely trying to infect someone with an enormously expensive to treat, life-threatening illness, a less serious crime. It's a handout to predators. California gets some stuff right, but they got this very wrong. It's not surprising that one of the bill's authors is from San Fagcisco. He's probably a "gift-giver" himself and doesn't want to get slapped with a felony for pozzing a little twink's neghole.
