Topic: France just made lolicons officially illegal

+Anonymous A13 years ago #25,883

> A change of the penal code introduced this summer now prohibits the drawing of minors in a imaginary pornographic context, with a sentence of 5 years of emprisonement and a 75 000 € (100 252 $) fee, even when those drawings are not diffused on the Internet or by any other mean

And, from http://www.legifrance.gouv.fr/ :
> The act of habitually browing, or otherwise in exchange of payments, a way of communicating to the public such pictures or representations, to acquire or to keep such pictures or representations by whatever means is punished by 2 years of imprisonement and a 30 000 € (40 101$) fee.

This will definitely make the lives of children safer, now that people can't draw imaginary characters!

Are you trying to bring about the collapse of society with your poisonous ideas that man's laws are imaginary barriers to free movement and liberty? Despicable.

@OP
lolwut. The law is silly but I think I understand what they're trying to achieve by imposing penalties on this stuff. Unfortunately I think if anything it'll just be counterproductive and bring more attention to this type of "art".

How can they possibly hope to enforce this? At the very least what constitutes as a minor in a drawing is completely up to intpretation, so unless a character explicitly says "I am 11 years old" or something then the law is already complete, and total bullshit.

Obscenity laws do not, and will not ever work, because what is "obscene" is a matter of opinion that changes often and differs from group to group.

on the other hand, there're plenty of Jap hentai gamez featuring "visually" underaged female in an kindergarden theme, while the game still declare "All characters in this game are 18+ years old".
Explicitly says or not, words are pointless.

If it's going to be as illegal as real child porn, why bother looking up drawings instead of the real thing? Unintended consequences.

It's a law with parameters up to interpretation. That's the point.

LOL

Actually it just means the courts will be tied up with prosecution cases to determine what does or doesn't constitute lolicon.

From junkuchan's doujin bookshelf:
"All of the characters depicted on this site are professional actors well over the age of consent in your respective country. All sexual acts depicted on this site were performed with full consent of the participants in a controlled environment under the watchful supervision of emergency response personnel. All of the content displayed on this site is artistic in nature and is in no way obscene, utilizing any of the content on this site for obscene purposes is both immoral and illegal.

If any of the characters depicted on this site tell you that they are under the age of consent in your respective country they are lying to you."

Courts clogged by cases brought about by poorly-worded/vague laws made by politicians who have no idea how to account for feasibility of enforcement when making decisions.

Happens all the time.

I just find it strange that this particular law is what everyone here is up in arms over. *shrug*
