You cant prove that they are under productive because of a one time thing. Also "the law is the law" has nothing to do with timing whatsoever. The law doesnt mandate that employers drug test after 4/20.
In addition, the legal ways in which people get fucked up like pills and alcohol, wouldnt even count for these tests, and they definitely encourage loss of productivity, and workplace accidents.

I've met many weekend junkies. I've also met people who booze it up all of the time, and never get caught because alcohol leaves the system quickly, and pill heads with multiple doctors who are on legal narcs and no one can say jack shit about it.

@OP, I am a senior employee where I work. I've written people up for showing up hungover. I don't give a fuck about my subordinates smoking weed in their spare time, because it doesn't affect their performance. Someone who is hungover is much more likely to fuck up than someone who smokes weed in their free time.
